Special thanks to the Florida Dispute Resolution Center and the 1,000+ attendees at this year’s ADR: Options and Opportunities (27th annual) Conference.

My keynote address covered various forms of cybersecurity risks (not just for mediators) including phishing, spearfishing, WiFi Pineapple man in the middle attacks, DDOS attacks, physical attacks, and other issues involving data breach and hacking.

We also discussed 10 ways to protect yourself and your business — in mediation, you will want to be on the lookout for parties discussing whether these steps were taken.

Finally, we discussed two final forms of potential breach – PDF redacting (which has been getting lawyers in trouble nationwide and questions of data retention policies. Do you really need to retain electronic documents from mediations for years? If not, avoid the risk of exposure.
